Contractual Will Agreements

This is a contract between the spouses (or de facto partners) where each agrees not to change their Will without each other’s consent. When one spouse dies the other is unable to change their Will.

These agreements are often used to protect the inheritance of children from previous relationships. They can also guarantee that a partner does not disinherit children.

Contractual Will Agreements provide peace of mind that your estate will distribute as you intended.

Beneficiaries can use the Contractual Will Agreement to sue the estate if your spouse changes their Will after you have died.

Before signing you and your partner must consider that you may never be able to sign another Will. If your partner passes away and you meet someone new, you cannot update your Will to benefit your new partner.
